3. Estimates and Quotes

Information provided through the Website, including descriptions of services and general pricing information, is for informational purposes and does not necessarily constitute a binding offer or contract.

Any estimate or quote provided by APT Painting is based on the information available to us at the time of preparation. The final scope, price, materials, preparation requirements, project schedule, and other terms may vary depending on the actual condition of the property and the requirements of the project.

A project becomes subject to a binding agreement only when the applicable proposal, estimate, contract, or other written agreement has been accepted by both parties.

Additional work, materials, repairs, or changes requested after approval of a project may result in additional charges and may require written approval.

4. Project Scope and Changes

The scope of services for a specific project will be determined by the applicable estimate, proposal, or written agreement.

Customers are responsible for communicating relevant information about the property and project requirements before work begins. This may include known water damage, leaks, structural issues, hazardous materials, previous coatings, or other conditions that could affect the work.

If conditions are discovered during preparation or performance of the work that were not reasonably apparent when the estimate was prepared, APT Painting may recommend additional repairs, preparation, materials, or services.

Changes to the project requested by the customer may affect the project price and completion schedule.

5. Property Preparation and Access

Customers are generally responsible for providing reasonable access to the areas where work is scheduled to be performed and for communicating any access restrictions or special requirements before work begins.

Customers should remove or secure valuable, fragile, or personal items from work areas unless otherwise agreed in writing.

APT Painting will take reasonable care to protect surrounding areas during the performance of its services. However, customers acknowledge that painting and repair work may involve dust, odors, noise, movement of furniture, and other temporary conditions.

6. Colors, Paint, and Materials

Customers are responsible for approving colors and finishes before application unless otherwise agreed.

Actual colors may appear differently depending on lighting, surrounding colors, surface conditions, paint type, and viewing conditions. Digital displays and photographs may not accurately represent the final appearance of a paint color.

APT Painting may recommend particular paints, coatings, primers, or materials based on the project requirements. Unless otherwise stated in writing, product availability and manufacturer specifications may affect material selection and project scheduling.

7. Existing Surface Conditions

The appearance and durability of a finished project may depend on the condition of the existing surfaces.

Existing surfaces may contain cracks, stains, holes, previous coatings, texture variations, moisture damage, uneven surfaces, or other conditions that can affect the final result.

APT Painting will perform preparation appropriate to the agreed scope of work. However, ordinary preparation and painting services do not guarantee the correction of underlying structural, moisture, plumbing, electrical, or other building problems unless those services are specifically included in the written scope of work.

8. Stucco, Drywall, and Specialty Repairs

APT Painting may provide stucco repair, drywall repair, popcorn ceiling removal, cabinet refinishing, and other specialty preparation services.

The extent of repairs will depend on the condition of the affected area and the scope agreed upon before work begins.

Repair work is intended to restore and prepare surfaces for the agreed project. Existing structures and materials may contain hidden conditions that cannot reasonably be identified before work begins.

Where appropriate, additional work may be recommended if conditions discovered during the project require it.

9. Project Scheduling and Delays

APT Painting will make reasonable efforts to perform work according to the agreed schedule.

Project schedules may be affected by circumstances beyond our reasonable control, including weather, material availability, property access, unforeseen site conditions, customer-requested changes, other contractors, or other circumstances that prevent work from proceeding as planned.

When such circumstances occur, we may adjust the project schedule accordingly.

10. Payments

Payment terms, deposits, progress payments, final payments, and other financial obligations will be established in the applicable estimate, proposal, contract, or invoice.

Customers agree to pay all amounts when due under the applicable project agreement.

Failure to make required payments may result in suspension of work, rescheduling, collection activity, or other remedies available under the applicable agreement and California law.

11. Cancellations

Cancellation and rescheduling of a project may be subject to the terms stated in the applicable proposal, estimate, or contract.

If a customer cancels or substantially changes a project after materials have been purchased, labor has been scheduled, or work has begun, the customer may be responsible for applicable costs or charges as provided in the applicable agreement and permitted by law.

12. Customer Communications

When you submit a form, request an estimate, call, email, or otherwise contact APT Painting, you agree that we may use the information you provide to respond to your inquiry, communicate regarding requested services, coordinate projects, and provide related customer service.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless APT Painting Inc., its owners, employees, contractors, and representatives from claims, damages, liabilities, losses, and expenses arising out of your unlawful use of the Website, violation of these Terms, or misuse of Website content.

19. Governing Law

22. Entire Agreement

These Terms constitute the general terms governing your use of the Website.

For actual painting or repair projects, the specific proposal, estimate, contract, invoice, or other written agreement between APT Painting Inc. and the customer will govern the specific services, pricing, payment terms, scope of work, and project requirements.
